I. Performance and Workmanship
Rayzor’s Edge Tree Services DBA Country Kiln Firewood (Country Kiln) has licensed and trained professionals. All work will be performed professionally, with the appropriate tools and equipment for proper job completion.
Safety: Country Kiln warrants that all firewood operations will follow industry safety standards. The client agrees to not enter the work area during operations unless authorized by the Country Kiln employee onsite. The client agrees to not have any animal off-leash on the property while any employee of Country Kiln is on the property for any and all services. If an employee of Country Kiln arrives on the property to perform any service and there is a loose animal on the property, the employee may attempt contact with the property owner to restrain the animal. If the animal is not restrained, the property owner may be charged a $50 mobilization fee in lieu of the service. If there are animal feces on the property that is in the path of the service provider, Country Kiln requires the feces to be removed prior to delivery.
Lawn and Surfaces Damage/Repair: Country Kiln will attempt to minimize all disturbances to the client's lawn and surfaces. To this end, Country Kiln's vehicles cannot leave paved surfaces as Country Kiln must utilize heavy vehicles and equipment to perform firewood services. In the case of a stacked service, a wheelbarrow must be utilized to bring firewood from the delivery vehicle to the stacking location. This wheelbarrow shall not be expected to scale stairs, maneuver inclines or travel more than 50 feet from the delivery vehicle itself.
II. Timing: Scheduling and Cancellation
In order to reserve a date for the contracted work to be completed, a prepayment in full shall be required. This prepayment shall be paid by check or credit card. and received before the scheduled date. If payment is not received before the scheduled date, the service shall not be completed on said scheduled date. If the contracted work should be canceled for any reason, cancellation fees in the form of forfeiting the delivery fee shall apply to any notice less than 72 hours in advance. If a notice of 72 hours or more is given for cancellation, the prepayment will be refunded in full.
Country Kiln will arrive on the scheduled performance date unless notice is otherwise given. Schedules are contingent upon weather, accidents, and other delays beyond our control and Country Kiln shall not be liable for damages due to those delays. Any delay in the beginning or completing the work shall not alter or invalidate any part of this contract, nor will it give the authorizing party additional rights or remedies.
Completion: If anyone has been dispatched to the job site and the Country Kiln employee is not able to complete the service, the customer will be assessed a mobilization fee no less than $3.00 and up to $500.00 for incurred expenses (based on the delivery fee attached to the order). In order for the delivery to be completed, the driveway must be clear of all snow and/or ice. Cars left in the driveway must be out of the path of the delivery truck/gates required to be opened for delivery purposes / able to be blocked in with a dumped firewood order.
III. Ownership & Permitting
Licenses: Country Kiln is insured for liability resulting from injury to persons or property, and all its employees are covered by Worker’s Compensation Insurance. The customer may request a certificate of insurance in their name for proof of insurance and to be entitled to updates of insurance coverage. The parties herein agree that in no instance may the client seek damages in excess of Country Kiln policy liability unless proven to be negligent. Further, once the contracted work is completed, the client agrees to hold Country Kiln and its agents harmless for any injury, loss, or expense associated with work performed or in any way related to services performed with this contract.
Permits: If required, the client shall be responsible for securing any permits or authorizations required to perform the work and shall provide copies of the same to Rayzor’s Edge.
IV. Contract Price
The contract price shall be valid for up to 6 months from the date of the proposal.
Completion of Contract: Country Kiln agrees to do its best to meet any agreed-upon performance date but shall not be liable in damages or otherwise for delays due to inclement weather, labor or any other cause beyond its control; nor shall the clients be relieved of completion for delays.
V. Terms of Payment
Unless otherwise noted in the proposal, the client agrees to pay the account in full upon scheduling of services. If a credit card was provided, the client shall agree that the charge will be in the full unpaid amount when due.
The client shall agree not to withhold any amount for completed and invoiced work in accordance with this contract for any reason whatsoever. Failure to remit full payment within 30 days will result in a $50 late fee for each 30-day lapse (30, 60, 90 days). After 90 days of nonpayment, the invoice will be turned over to collections. The customer shall indemnify Rayzor’s Edge Tree Service for all costs incurred in collecting such unpaid amounts.
Types of Payment: Business or personal checks and major credit cards are all accepted.
All coupons or issued discounts must be within the original contract and can not be submitted after work is completed or invoiced.
Returned Check Fee: There will be a $35.00 fee charged for all checks returned to our office for insufficient funds.
VI. Termination
This contract may be terminated by the client no later than 72 hours before work is scheduled to commence. The client may only terminate the work less than 72 hours before the work is scheduled to commence by paying for any work already performed and for any expenses incurred in preparing to perform the work.
VII. Insurance and Liability
Country Kiln warrants that it is insured for liability resulting from injury to person(s) or property and that all employees are covered by Worker's Compensation as required by law. Certificates of insurance coverage are available upon request.
Ownership: The client warrants that the delivery to the property listed on the contract has been coordinated by a person who either owns said property or has received full permission from the owner to allow Country Kiln to perform the specified work outlined in the contract.
VIII. Miscellaneous
This contract shall be governed by the laws of the State of Connecticut. This contract contains the entire understanding of Country Kiln and the client with respect to the work and reflects the prior agreements and commitments with respect thereto. There are no other oral understandings, terms, or conditions and neither party has relied upon any representation, express or implied, not contained in this contract. This contract may only be amended by a written amending agreement signed by both Country Kiln and the client. No waiver by either party of any breach or provision of this contract will be binding unless made in writing, any such waiver will extend only to the specific breach or provision waived and not to any future breach. Indemnities against, release from and limitations and exclusions on liability expressed in the contract will apply even in the case of the fault, negligence or strict liability of the party indemnified or release or whose liability is limited and will extend to the benefit the employees and affiliates of such parties. The prepayment for services shall prove understanding of the aforementioned terms and agreement.
